Thanks For that Jimmy But A hero is a sandwich! The question of legality of these bikes is one that needs to be addressed once and for all! whether it goes my way or not is yet to be determined? I just cannot get over the fact the cop concentrated his efforts on some guy riding a bike instead of the real lawbreakers?

Thinking more about what Jimmy wrote' Maybe we all need to take this issue to a higher court? If enough of us fight this issue and tie up the courts then maybe the boys in Blue will Learn? just a thought"

Actually we need to host bike rallys and invite community leaders to participate. This provides publicity and public support. Thats when lawmakers act. Going through the courts is a loosing proposition for all involved. Time, money. The legal system is not based on whats right, its based on what you can prove. In my opinion I can prove its a bike with a bike motor attached. Doesnt mean I actually want to tell a judge that.

I have read this entire post, and I am fascinated and highly entertained. RonB, I wish you the best of luck, and my hat is off to you for keeping your cool through this process...especially the license error. I would have freaked out!

By freaking out, I mean I would have said snarky comments at everyone. Like 'Yay, Justice.' and 'Well, this seems worth the tax money....your honor.'

I think I would have gone to jail by now. lol

I am sure everyone here is dying to find out what happens! Good luck!!

Went back to court today, now it`s getting interesting! the prosecutor (3 of them) showed up in force today with a fight on there minds as they refused to dismiss this case, As i listened to what they said i still get the impression they think i was ridding a moped even though my attorney used the term motorized bike several times, anyhow the judge was ready to call up a jury but the prosecutors were NOT ready for that as they want to bring in the cop as a witness so with said the case has been re-scheduled (again) for May 9th at 8:30 am . this should be it? the big day! The day we find out by a jury trial if these bikes are in fact motor vehicles? If anyone wants to sit in ? just pm me and i will give you the details!

It has been brought to my attention there might be some confusion as to where this trial will be? It will be at the Pinellas county main courthouse on 49 st in Clearwater Fla. Also if i`am found guilty on the 9th i may have been incarcerated? so if i do not return here on that date with good news you will know at the very least what the verdict was?

It would be to your advantage, and ours.

You must pedal it anywhere you go... if you wish, you may decide to have the motor assist you. For whatever reason.

(gosh I hope it's got pedals and we're talking abt a chinagirl with less than 2bhp)

the bike in question is a single speed 2 stroke motorized bicycle with pedals(must pedal to start rolling or otherwise will just stall)! my lawyer is thinking of bringing it in to the courtroom to show the jury and explain it is a single speed assisted motor. funny the prosecutors picked up on the electric motor driven bikes being o;k to operate without a license and the gas Not o;K? with that kind of thinking then one could drive a Nissan leaf(100% electric car without a license) I see that argument coming, not so much with this case but from some other , at some point? Rest assured thought I intend to do my best to convince a jury of my pears to see it our way! I`am putting it all on the line, my freedom as well as the money i had to borrow to pay my attorney! If any one wants to support the cause and can spare the time to join us in the courtroom? you are welcome to do so! it is going to be interesting to say the least, their will likely be a dash cam video as i have asked my lawyer to get it. also the prosecutor may call in someone from the DMV for interpretation of the statute for the jury? if that happens We will through the notarized copy from the DMV James provided us and have him explain that why it is anyone can physical get one of these copies simply walking in to any DMV and asking.

Talked with my lawyer yesterday and it seems there is no dash cam video as we have requested it for trial, the state prosecutor has told us this! Funny how every DUI arrest has a video that shows up in court? sounds like the state has only the cops testimony now as evidence? to bad" i wanted the video shown so the jury could see how the cop reacted when i told him one of his associates told me to get the bike on the sidewalk!

Yeah Florida needs to pick a side and stick to it not have all these vague laws and no clear definition of what their specifications on getting one tagged. Untill then i guess were all outlaws

Only when the defense does it! We have(my attorney and I)discussed what the cop will say when questioned about the comment i made to him and We both agree he will likely respond that he does not recall" I would put money on it" so the line of questioning will go something like this> Is your cruiser equipped with a dash cam? is it not procedure to record all traffic stops? was this particular stop recorded? where is the recording? This questioning is designed to cast doubt for the jury!

PS - I think a better term would be "power assisted" bicycle, to match the actual law when describing legal electric bicycles.

Wait till you here this" The prosecutor informed my attorney today they will NOT be seeking a jail sentence " what this means is there will be NO JURY trial tomorrow! they will be seeking a 500.00 fine! (You DO not get a jury for a misdemeanor) they did this to level the playing field in there behalf due to a week case as they only have a police officers testimony with no dash cam video, this is extremely disappointing for me because if there was a jury who would listen to evidence presented and make a decision solely by reasonable doubt i think i would win! now it is going to be decided by another judge who will most likely side with the officer and prosecutor! isn't that just great &&%^%^^%***^*&^&() Well i have instructed my attorney to let them know up front I do not have any money and would prefer jail as opposed to having to pay a fine" after all I`am living in a trailer with no facilities so maybe jail might be a step up for me? A hole entire year i have waited for this jury trial! you want to talk about a kick upside the head? this sure is it! I promise you all i will find and ride on any and all sidewalks from now on with undue prejudice!

WTFrig!!! This is so anti climatic... i thought u'd set a case precedence.... I was thinking about traveling from N. Florida to see ur trial... oh well.

Yea I thought so too and my attorney and i were optimistic until this, I just typed up a paper for my lawyer to argue this change in venue , one that expresses our concerns for lack of fair and impartial trial without a jury and stating that NO ONE pays a fine for riding a bicycle on the sidewalk and that I could not pay one if found guilty! we shall see how that goes?
