Is my pedal too close to the muffler (pic)?

Hey guys, I bent my pipe today to get it onto my bike. The crank clears the muffler now, but it's cutting it close. See below pic (this is the closest the crank comes to the muffler).

To give you perspective, I took out my calipers and the distance is about 7.5mm. Is this too close? I don't want to have to bend it again unless absolutely necessary.

Second question - where does this muffler clamp go?

If it does not hit, it is far enough away.
If it hits, bend it some more.

You've got plenty of clearance as GearNut said, as for that muff clamp, I throw them into the trash and make my own that last much more than one week.....seriously.

I left the heat shield off, I felt it would cut my calf if I was not careful.
