The law says 50cc or less and 2 hp or less.

I don't know of any China girl motors rated 2 hp or less.

I would think that if we are to challenge the police and call our bikes mopeds then we should be 50cc or less and 2 hp or less.

If I am wrong I am sorry.

Right ? The sticker on the side is nice for legal reasons.

I don't have the nads or money to try it and I hate going down town Tampa to the courthouse.

I have a dl and have not had a ticket since 1985 and pay real low insurance rates.

Any ticket could make my rates go higher.

They just raised my rate because of all the insurance fraud in Florida.

That is what they claim.

Here's the thing...

According to the people that believe you don't need to register, nor need a license, and make a gas bike legal for road use, would also have to believe that there is NO requirement that would limit the horsepower, CC size or speed, since a gas bike doesn't conform to any "moped statute".
(In other words, you can't say a gas bike is not a moped and THEN use the moped definition to say 50cc/2hp is the max allowed for the bike that is not supposed to fit the definition in the first place - I hope you understand what I'm saying)
Basically those people would then have to believe you could put a 250cc engine on a bike and be able to do up to the speed limit (55 mph on most major (non-turnpike type) roads) with no need to worry about "legality"

Think about it, since there's no limit to speed, up to the speed limit, you could conceivably ride WITH traffic ANYWHERE YOU WANT!

Not exactly. It's probably true size doesn't matter, but self propelled or not matters. Much over 50cc will be hard to convince a jury it's not self propelled.

yay for making up our own laws.

you have proved SANGESF's point that many here have decided on their own laws & how they are applied.

there hasn't been anything posted in these threads that PROVE anything to toward the positive of legality. though somehow many now think they are legal based off of the same info they had before the hersay.

we are still waiting on that "proof" that was promised.

For me proof that a MB is illegal would be a conviction. Find one and you have proof a MB isn't legal. I'm pretty sure you can't find one.

I'm kind of the same as you about the birth certificate lol.

You know when someone goes to court it becomes public record. What we know is someone went to court and won. If you don't believe the news article, you can contact the court and find out for yourself, which is more than we can do in the case of the birth certificate.

yes we will call up the court & give them all of the useful info that was given to us. i kinda forgot where it was posted could you help us find it? /sarcasm

there is no national laws on gambling. except that it is state dependent.
state laws have nothing on online gambling. yet there is a national law on gambling.
also there is no national law that says you must pay taxes. just laws for evading taxes. no one can find in on paper that you required to pay.

earlier you said there were no laws giving rights. only to restrict right.(or something like that)

i do appreciate your effort in mixing DL laws,registration & what the DOT will let on there roads.

have you thought about why a crane is not allowed to drive down I95? or a race car can have a term called "not street legal". (hint DOT,safety)

well here in florida we have lots of laws & someone is always trying to sue someone else. we have lawyers that are next door to county courthouses that guaranty to get you out of any ticket.
being you feel comfortable with what you believe to be FL law, do you feel comfortable with someone going into court on your advise?
keep holding the torch faith based legal advice.

Considering i work at a local city hall, i could. But the city i work for, is not the city i live in. I'd have to bring it up at both places. Which is ok, but to make them legal on roads without a DL, idk if it would even be considered. There's so much against it. For example, young kids already ride these, people would be driving on these while drunk, people racing down the street alongside cars, it would be a distraction to other drivers, etc. After i go to court and fight this citation, if i lose, i'll bring it up at the next meeting. Meetings are always the 1st Tuesday of every month.

I sold an electric bicycle to a fella and he brought it back busted up with a busted rear wheel.

His dad had wrecked it.

He said he likes to ride it when he gets drunk. :(

You can see ads on Craigslist calling electric bikes dui bikes. :(

China girl bikes would also become dui bikes. :(

Motorized bikes for people with drinking problems :(

If you can find out what happened in the case we know about that would help in your defense. It will probably be hard to find information about it though. In my experience when something like this comes up the court usually dismisses the charges, and tries not to have any record of what happened.

When you get to court tell the judge you plan to plead not guilty, and you want a jury trial if that's allowed. The judge will hate that idea, and then make you an offer for a reduced fine if you'll just pay the ticket.

Inform the judge that in Florida all motor vehicles have to be self propelled for you to need a license, but your motor bicycle is not. Tell him Paula Paxton already fought and won a challenge of the same nature in the 14th Judicial Circuit court on or around August 21, 2011 . That should at least force the prosecutor to look up the record of the trial if there was one. At that point they'll either throw you ticket out, or set a trial date.

If they set a trial date, expect it to be dismissed a couple days before the trial, but in case they don't you'll need to be prepared to fight. I can't see any way for the state to win, especially since there's already been a challenge that was won for the same thing. If you should happen to be found guilty, it will be grounds for an appeal.
