I don't know of any China girl motors rated 2 hp or less.
I would think that if we are to challenge the police and call our bikes mopeds then we should be 50cc or less and 2 hp or less.

Not exactly. It's probably true size doesn't matter, but self propelled or not matters. Much over 50cc will be hard to convince a jury it's not self propelled.Here's the thing...
According to the people that believe you don't need to register, nor need a license, and make a gas bike legal for road use, would also have to believe that there is NO requirement that would limit the horsepower, CC size or speed, since a gas bike doesn't conform to any "moped statute".
(In other words, you can't say a gas bike is not a moped and THEN use the moped definition to say 50cc/2hp is the max allowed for the bike that is not supposed to fit the definition in the first place - I hope you understand what I'm saying)
Basically those people would then have to believe you could put a 250cc engine on a bike and be able to do up to the speed limit (55 mph on most major (non-turnpike type) roads) with no need to worry about "legality"
Think about it, since there's no limit to speed, up to the speed limit, you could conceivably ride WITH traffic ANYWHERE YOU WANT!

there hasn't been anything posted in these threads that PROVE anything to toward the positive of legality. though somehow many now think they are legal based off of the same info they had before the hersay.
we are still waiting on that "proof" that was promised.

You know when someone goes to court it becomes public record. What we know is someone went to court and won. If you don't believe the news article, you can contact the court and find out for yourself, which is more than we can do in the case of the birth certificate.

For example, young kids already ride these, people would be driving on these while drunk, people racing down the street alongside cars, it would be a distraction to other drivers, etc. After i go to court and fight this citation, if i lose, i'll bring it up at the next meeting. Yep.But, even a stock bicycle can get you a DUI if your caught.

When you get to court tell the judge you plan to plead not guilty, and you want a jury trial if that's allowed. The judge will hate that idea, and then make you an offer for a reduced fine if you'll just pay the ticket.
Inform the judge that in Florida all motor vehicles have to be self propelled for you to need a license, but your motor bicycle is not. Tell him Paula Paxton already fought and won a challenge of the same nature in the 14th Judicial Circuit court on or around August 21, 2011 . That should at least force the prosecutor to look up the record of the trial if there was one. At that point they'll either throw you ticket out, or set a trial date.
If they set a trial date, expect it to be dismissed a couple days before the trial, but in case they don't you'll need to be prepared to fight. I can't see any way for the state to win, especially since there's already been a challenge that was won for the same thing. If you should happen to be found guilty, it will be grounds for an appeal.
