But officials from the Ontario Ministry of Transportation and Waterloo Regional Police say they’re illegal motorized cycles. They’re not the same as electric e-bikes, which run on batteries and are allowed under special provincial legislation.
both author-ity types say "they're illegal motorized cycles", whats a motorized cycle, can someone show me a legislated definition somewhere of what that is, I dont belive it exists, but if it does, I'd like to not be ignorant of it. Thanks

Nothing in any of the current Ontario acts mentions "motorized cycles". Could they have been referring to the long gone definition "motor driven cycle?? Who knows.

The federal government repealed "motor driven cycle" from the motor vehicle safety regulations in 1988.

Hey everyone, I went to court this past Monday , they dropped the unsafe vehicle and helmet charge and dropped the driving while under suspension to driving without a licence and they gave me a 160.00 fine, the bikes are definately illegal here and dont see any light at the end of the tunnel to make them legal at all somehow... so... I guess I'll either be selling the bike as a unit, or park it and I'll be getting a chopper style e-bike and get a friend of mine to modify it so it will go a bit faster and get it changed to 24 volts... lets see what happens, I'll let Y'all know ....

Congratulations on getting everything dropped to a single charge. Even though a $160 is
not cheap what it could have been, might have been huge.
Glad someone looked at it and said this is crazy for a guy riding a bike with a motor on it. Reasonable fine for no drivers license compared to what that could have been.

Try and get the ebike bumped up to 36 volts. You will be much happier and 48 volts would be perfect. Better speed and distance and the motor won't over heat as it goes along. Check out Endless-Sphere.com. A lot of ebike info on there and people who can answer your questions.

so are you going to pay the fine or are you going to appeal it was there any mention on your ticket to exactly what you were driving and was the serial number off the bike on the ticket i received almost the exact same ticket here in hamilton a few months back i never did pay the ticket and i have not heard anything more about it i am still riding my bike but i am sticking to side roads and have not been stopped since

Of course I'm gonna pay it, I plan on having my drivers licence by the time next fall arrives,... being ignorant of the law and not paying my fines wont help me get too far in life and I wanna have my licence back by next year

You on the other hand seem very ignorant of the law and your fines will just escalade even higher when they pop you the next time and then they learn they already got you, they will definately sieze your bike and you will walk away with about 6 grand worth of fines....

Ebikes .com. They are just north of me in Vancouver so that works out for me quite well but Justin the owner has taken a ebike across Canada, sea to sea. He has only the best equipment and is always testing that to make sure it's good.
His cross country ride is on endless-sphere and you will see his name mentioned a lot there and always in a good light.

Thanks Steve I sure will check it out ! I'm hoping that chopper will accomodate me, if not I'll have to lengthen the frame so it's at least semi comfortable lol, I sure did enjoy the 2 stroker while I was on it, it's too bad about them because I'm sure a lot of us used them as daily transportation and just to go for a ride, myself if they made a law for them that would allow us to ride them I would be going for it...

Peter... I dont mean to make it sound like I am flaming on you but you have to understand that each time they pull you over if they catch you if you flee , that is another charge which is criminal on top of the motor vehicle laws they nail you with.... take care....

I think you got ripped, because you don't know the legal definitions of the laws you're dealing with. In other words you got railroaded.

For instance, they claimed you were riding a motor vehicle right? What's the definition of a motor vehicle where you live. Here in Texas it's defined as any self propelled vehicle. by that definition is you bike a motor vehicle? Mine wouldn't be becasuse I have to peddle it before I can let the clutch out to get it to go.

If you're driving a car, and at every stop you have to get a out and push it up to 4 or 5 mph before you can get in and use the engine to propelle it on it's own, would you call that car self propelled? Would a jury?

Not talking about starting.

If it can't move on it's own from a dead stop, it's not selfpropelled. If it's not self propelled then it doesn't fit the definition of a motor vehicle. Court challenges are won by this type of legal nit picking every day. Just like the date being off by one day on a ticket.

Don't just ask, read the statute for yourself. I've been told a lot of things here in Texas that later turned out not to hold up in traffic court.

I've had a lot of success with court challenges.

I'm one of only 2 people that ever beat a camera red light ticket in Garland Texas. They told me it couldn't be won. I got a local TV station to come to the courthouse and get me on camera receiving my original check back after winning in the appeals court. Then I went on camera and told everyone that the city was not following the law and was stealing thousands if not millions of $$$ for people. The city attorney really loved that.

I used to love poking an angry bear in the butt with a short sharp stick but had to give it up when I found out that the bear could run farther and faster than I could.

Well it's certainly good news that they tossed some of the provincial offence notices in the trash bucket but it's typical that they kept one on the record for their own books which of course sets some legal precedent for future reference.

Couple questions...

Was this "deal" worked out with the crown counsel before appearing before "your honor" or was it your honor that said ok I'll toss this and this and reduce that to this after you explained your case?

Did you have a lawyer?

Modified bicycles are not illegal in Ontario and as I and others have said before there is nothing written in any of the Ontario acts that says they are. Where the argument really is is can a resident of Ontario build and use a modified bicycle on anything other than private property. As an example in Ontario if you purchase a bicycle at Daymak in Toronto that's been modified in China to use an electric motor as supplementary propulsion your good to ride wherever you please yet if you build something similar in your own garage your somehow in conflict with Ontario's acts the moment it leaves your private property.
