hello everyone, i have been working at this for a long time now. i now have a document from the tag and title office specifically stating that regardless of what gas engine kit is mounted to the bicycle; that it is still considered a bicycle. i am now in the process of presenting this to my local Senators office for review to get the definition of a bicycle in florida statue 316.003 to include the gas powered engine kit. here is the website to the information. simply go to the very bottom of the last page and it is there for everyone to read in black and white of what the DMV in Florida thinks about the motorized bicycles. knowledge is power, spread the power and help get this changed. http://www3.flhsmv.gov/DMV/Proc/TL/TL-10.PDF as you will see this is a recent judgement made on March 16, 2010. have a good day

How about showing us specifically what should be done to help you out with this...

For those not wanting to read the PDF, I have quoted the relevant part...

3. Scenario: A company is advertising on TV a gas engine kit that can be added to a bicycle. The engine is tied into the pedal system like a Moped and it has to be pedaled to start the engine. It is advertised that the bicycle will be propelled to 30MPH.

Q. How is the tax collector supposed to register this bicycle/gas engine assembly?

A. The definition of bicycle under s. 316.003(2), F.S., includes motorized bicycles. Bicycles are not registered or titled. Engine kits for bicycles are not new and there are a variety of kits available, however, they remain bicycles after the engine kit is installed. There are other requirements that must be met to be classified as a motorcycle/scooter/moped such as frame assembly and safety features. If a customer brings in paperwork for a bicycle, they cannot be legally issued a title or registration nor is it required. The agent should also direct the customer to law enforcement if there are any questions as to where the motorized bicycle can be used.

The only problem with that scenario, is that it is still quite vague......

Here is what I think (also posted on another thread)....

You will notice that in the Scenario part mentions GAS, the "Q." part asks about REGISTRATION....

HOWEVER the ANSWER gives you the Floridian Statute 316.003(2) and THAT is about ELECTRIC bikes and the ANSWER ALSO states that you can NOT register it, which has NOTHING to do with Licensing of a gas powered bicycle (moped)

Now here comes the "tricky" part....
If you can't REGISTER it for use on the Road, TECHNICALLY SPEAKING, you are NOT allowed to RIDE it on the road as a MOTOR Vehicle. Now a GAS bike IS (by Definition) a MOPED and TECHNICALLY a MOTOR Vehicle, when it comes to LICENSING, So technically it's not approved for road use.

i have a DUI and i'm dying to make one of these kits but i'm concerned with the legality issue. even though it's not intended for road usage, and illegal for sidewalk usage, it is still considered a motor vehicle and requires a license. so i shouldn't use my bike (or the motor atleast)?

unless you live (and ride only) in daytona, you will need a license, until the law is changed.
The only way is to go electric, you can easily go electric, and do 20mph fo 100 miles+, the only problem with that is the expense is somewhere in the neighborhood of 3 times or more the price.

Bicycle with added motor cannot be registered.

As long as it didn't start it's life as a bicycle that is....

You can't get a plate for it, they will NOT register it.

IF they do, then you're lucky. It's in their codes that they can not register it without a VIN.

Thanks i didnt have that info i'll take a note.
Then i guess just go buy a used moped and register it then mod it anyway you like,even change the motor to a bicycle motor.

I lived in West Palm Beach FL for years and i can tell you that I was never messed with by police i live in NC now ive not yet had a problem

Many people say they have not been messed with YET, that is until a cop gets bored and gives you a handfull of tickets.

If you were going to spend a few hundred on a engine kit and bike and then spend a few hundred on tickets,just save your money and invest it in a legal cheap used moped or scooter.

How long ago did you live in west palm beach, because as with everything else, laws change year by year
not longer than 2 years ago I used to ride up gun club rd...where the jail is at cops came and went
never stopped but once cause i was riding on the sidewalk he gave me a verbal warning.also i was in the richy part of downtown WPB when i was stopped.wee.

Based on what Ive read, you seem correct, NO REGISTRATION/ NO TAG.

I'd like not to believe you. There is a veeery small gilmmer of hope.
