In Pennsylvania, under 50cc = moped, but also requires brake horsepower 1.95 or less, top speed 25mph or less, and automatic transmission (no clutching to shift). Anything over 50cc's or anything that requires clutching to shift is automatically considered a motorcycle. Most cops don't know the law. It used to be under 50cc's was legal, no license or registration. Most cops still go by that.
