I gave him a paper that SHOULD get him off VERY EASILY!

I just hope he takes it with him to court.
I can't explain what the paper is, until his court case is finished...
I don't want the Prosecution to have a heads up..

All I can say is.. That once picklefish is finished with this case, I'll post the document I provided him...
If he does NOT win his case, he can use the document I gave him to appeal it in a higher court..
This should be an exciting outcome.

Once this is all said and done, I'll be adding a 49cc motor to my electric bike (yes - I'll have two different types of motors) and have, easily, a 100 mile range on 1 tank (1/2 gal of gas) and 1 charge of my batteries..
All limited to 20 mph capable and no higher!

Today I had a day in court. The prosecution dropped the charges relating to my bike being an unregistered motor vehicle. They also reduced the possession of a suspended licence charge to an invalid licence charge so I don't get any points on my licence or strikes against me towards Floridas' retarded habitual offender law. 500 fine and 50 hours of community service. Still sucks balls but its better than what coulda' happened.

Lesson learned; When pulled over by police you have the right to remain silent, and a right to an attorney. Don't talk to them, answer questions or try to be helpful.
In Florida, have a valid liscence and keep yer cc's down below 50 and you should be fine, anything other than that and you got to tangle with the law and the law always wins.

Another thought that came to mind; Florida Courts do NOT care about the statutes, they care about the precidents set in the case law records. If you think that you can use the statutes to defend yourself in a trial you will most likely lose. The prosecution will just reduce the charges to avoid having a precedent in favor of motor bicycling on the books. Until someone wins the lotto and sues the state to have specific verbage added to the books, ride at your own risk. Now that my case is resolved Im planning on getting an add on metal plate that says my motor is 49cc's at least and Im gonna be real paranoid while riding but at least I have a valid liscence now though, one less thing they can get me on!

Picklefish, they dropped the riding an unregistered motor vehicle ticket? So they found you guilty of possessing a suspended license? I assume that charge has nothing to do with riding a motorized bicycle, is that correct?

I seems like as far a motorized bicycles are concerned you won that battle. Congratulations!

Don't feel bad, that's exactly the same thing that would happen here in Texas, except in Texas it's doubtful a cop would give anyone a ticket for unregistered motor vehicle on a motorized bicycle. Here if you challenge a ticket of that type they would do the same thing and dismiss it. They would be counting someone just paying the ticket without challenge.

I agree with that, however its a really hollow victory since there wont be any case law supporting our position.
Yeah it's not perfect but at least you can ride free. Also consider this, if the police keep giving you tickets that have to be dismissed, you could sue them for harassment.

Either you were guilty of what they accuse you of, or not..
I don't see how they can get away with changing the charge to a different charge if they can't win on the one they are accusing you of. (I think THAT'S where a lawyer could have helped you).

Please give a detailed list of what happened..

I brought it and we never set a court date. The public defender was a different person with nice boobies, so I listened to her. She marched right over to the State Attourneys desk and said whats what.

Also, be a little more specific as to what happened...

Basically The charge they had me on no matter what, was possession of a suspended liscence. I lied in court, prior to being sworn in, and said that the engine was less than 50cc's. No body fact checked and the state attourneys promptly offered to drop the charges relating to unliscenced motor vehicle and operation of a motorvehicle with a suspended liscence. They then dropped the possession of a suspended liscence charge to an invalid liscence charge since my liscence had been reinstated by then.

Because they all base their findings on previous case law precidents set by other Florida courts. Now yes I could've refused the deal and gone to trial, but it wouldnt be a jury trial and there is a good chance my argument wouldnt beat the previous case law. Since I didnt have an attorney, my argument wouldnt hold as much weight since I am uneducated in their eyes. Plus, if by some miracle the State Attorney thought they might lose, they could still drop the losing charges so there is no case precident put into the books. Its all a giant scam called the legal system.

Either you were guilty of what they accuse you of, or not..the law doesnt work that way anymore. The only thing that counts is do you have an attorney and can you prove your innocence in court.

Public defender = no charge to you.
So why didn't you continue with the innocence? And with the public defender, for free?
"Basically", you pleaded guilty to riding without a license and just had them lessen the charges to something else.
Some might call that a win, but I don't. :(

You dont have to prove your innocence, they have to prove your guilty.
And even if they did drop the charges, that doesn't set case law..
Only losing and then going to appeal...
If you thought you were gonna set case law by just winning, you were misinformed from the beginning.
Did they give you any indication as to what "case law" they were gonna use against you?
Did you ask for Discovery from the State's attorney?
Sorry if you went through this whole thing thinking that just "winning" would help others.
Maybe I should have been more clear as to what you would have to actually go through to get the desired result?
What difference was it THIS time as opposed to the FIRST time with the ORIGINAL Public defender? (If it was just waiting for you to get your license re-instated, then I could see WHY you took the Plea, otherwise, I don't get it)

all I can say is I chickened out. The origional public defender said if I didnt like his approach I could fire him, so I did. The new one was a girl and seemed more reasonable. My daughter recieved a ticket for speeding 32 miles over the limit recently and went before the same judge, she got fined 350 bucks and told not to do it again. The justice system sucks and I was scared if I lost at trial my results could've been worse. They ruin lives and they dont give a ****.

That's how they getcha! They know most people wont go all the way because of money. And that's why a majority of people in Florida have gas powered bicycles, in the first place. (Money issues).

As I said before picklefish ultimately had to CYA. You can't blame him for that!
It is the system that preys on those that can't afford a car or don't have a license because it's all about the money. I don't think anyone will eve be able to completely go through the entire process, especially if there is a possibility of jail time or exorbitant fees unless they have the money to do it but if they did they would just have a car or a license and get a moped and not have to worry. Again 99% of the time it has to do with the money.
