alright just got off the phone with the lawyer only thing thats gonna stick is driving with out a license and speeding everything else is dropped. and im ok with that, im just glad this got cleared up

the citation was a re write since they cant charge me for not having it registered because i live in Wisconsin but was driving in Michigan, its now just a speeding ticket. and i had filled for my license to be reinstated and was waiting for the insurance to go threw so my license would be reinstated. i have my license now but at the time it was still in processing

yeah it probly is but at this point im just gonna take it pay the fines and move on don't feel like dealing with the issue anymore just wanna get it over with at the moment

yep i just ordered a turn signal brake light kit and some mirrors and im gonna go with a bigger sprocket for more low end torque and to bring my top speed down that way i dont have to worry about how fast im going in the higher rpms

That just got saved to the blackberry.

I've got the Bicygnal wireless kit but it needs to be wired! I would gladly have paid the $80 it cost if it was wired. But its not so I kinda feel shafted.

When you get that wired to the lipo I would like to see what you got. I need something more dependable than what I have.

alright ill keep ya posted on my progress. im waiting on parts to fix my buddy's bike (fried mag and cdi), and after that's taken care of im gonna start on the brake turn signal rewire.

and given the run around for about an hour taken to jail bike impounded and a ticket written for not having a license not having it registered and no head light tails lights when i did in fact have a 900 lumen headlight. im in Michigan btw.
so tomorrow im getting a lawyer and and fighting this. ive read the laws and i wasn't breaking any cept for going 30 after going down hill in a 25 >.>. and i was 300 feet from a 35 mph zone when i got pulled over to.


im the third person they've hassled over this the other 2 got the cases thrown outta court and nothing happened. beside having to pay to get the bike outta impound.
I'm glad it turned out better than it seemed at first. I think you could have done better though.

Either there is, or there isn't, law covering gas powered motor bicycles. If there isn't, then the only ticket that was valid was the one for speeding. Even a bicycle can be ticketed for speeding.

Any advise about not fighting a ticket is bogus. I fight all traffic tickets myself. Lawyers usually just want to make a deal and call it good. There's no such thing as thousands of dollars court costs for traffic court lol.

Always assume you're not guilty. If you're not a lawyer you're not qualified to know if you're guilty of anything. Make a jury prove it.

They probably impounded you bike over the no registration ticket. Since the charges were dropped, you could demand you money back.

Most people would be surprised how easy it is to win in traffic court. The hardest ticket to beat is for running a stop sign, so be careful about that.

I'm the second person in history to beat a camera red light traffic ticket in Garland Texas. They crapped their pants when I had the a local TV station in the parking lot waiting to talk about the verdict. I told the world in front of the camera that Garland was illegally ticketing people for millions of dollars, as I held my original check, that they had to return to me, up to the camera. They had to put the city attorney on tv the next day to lie his ass off doing damage control.


I think beating a ticket on a MB would be very easy, as long as it's not for running a stop sign.

i would like to try and fight it cause as the attorney told me Michigan doesn't have laws for motorized pedal bikes. but i dont really have the money to pay court costs i live on 771 a month >.> and cant afford much.

Court cost for pleading not guilty and losing a jury trial can cost A LOT. If you ever lost a jury trial, then you would know. Maybe not thousands, but it may as well be if you are turning a hundred dollar speeding ticket into a several hundred dollar speeding ticket.

Get a different Lawyer if you choose to go to court. One that has read the MI SoS website at the very least. Just because it does not literally say "motorized bicycle" doesn't mean it isn't covered by existing law. It's a matter of semantics.

It's sort of like a verbal flow chart. Does it have a motor? Yes. Does it have two wheels or four? Two. What is the engine displacement, how fast is max on a flat? Answer to this determines if it is a Moped or a motorcycle. http://www.michigan.gov/sos/0,4670,7-127-1585_15242-236804--,00.html

Next is getting it road legal. Basic equipment? Minimum requirements are on the SoS site. Does it have a VIN? No. It is an assembled (I'll assume) Moped. The serial number on the bike frame or engine doesn't count. The VIN is a number in a specific format that describes the vehicle. Get these forms:

"Michigan Department of State VEHICLE NUMBER AND ON-ROAD EQUIPMENT INSPECTION" TR-54 (02/05). Get the bike inspected by your new friends.

"APPLICATION to REGISTER a MOPED" R-2L (6/99) and "APPLICATION for SPECIAL VEHICLE IDENTIFICATION NUMBER" TR-204 (7/95). Bring your receipts because the State wants its 6% on the out of state transactions at the time the bike is registered. Don't have them? Let them know the parts are used/salvaged.

After all of that you'll get a nice sticker good for three years as a registered Moped and a VIN decal will come in the mail to put on the bike. When you sell the bike that registration and VIN has value.

In absence of a specific law for a gas powered motor bicycle, the next most important thing to find out is what is your states definition of a motor vehicle.

In many states the law defines a motor vehicle as, all motor vehicles are considered self propelled. So if there's not a specific law for a motor bicycle, then it's going to be difficult for a prosecutor to get a conviction if you were on a china girl style MB, because if you can't ride it off from a stop without pedaling, you can't really consider it self propelled.

Another definition to look at is the one defining a moped. Many states define a moped as a motor driven cycle. Motor driven cycle is just another way of saying, self propelled.
