Second hand muffler- is this ok?

I stole the pipe off of my parts bike, and it barely fits. As you can see it actually rides on my pedal crank. It does not rattle or bounce around at all. I'm willing to accept the metal-to-metal contact wear until I get it bent (or don't). It appears to make contact on a weld, but that's just the photo.
It's quite a bit cooler than the valve cover or gearbox. Sounds good too!
What do you think?

Thanks maniac, I worry about screwing something up, so it's nice to have someone else put their eyes on it.
