i got pulled saturday. its was kinda funny inna way.the 1st cop asked wut was i riding?lol i had to explain it. then he got to looking at my helmet. called it a skate helmet. i corrected him..its BMX helmet (been wearing it on all my MBs for almost 2 years now). so he keeps on N on more like not liking my MB. so he goes back to his car with my ID. anuther cars show up. they sit there for like 15 to 20 mins. imma looking at the sky. snow flakes were starting to fall. they come back and give me a ticket for improper helmet. saying imma moped under NC law. i looked at the ticket put it in my coat N said ok wutever and went to the store i was heading to then had to ride in a kind a heavy snow shower on the way back. i survive N so did my bike. i got a motorcycle off my cousin today so imma good to go when i go to court next month. just gotta show the DOT sticker N all and its dismissed as they told me. more like a waste of time (my time!). i dont like cops by the way lol

Yeah it's bs alright. Here in Texas we're allowed to carry $10,000 medical insurance instead of wearing a helmet. It cost about $50 a year to let your freak flag fly.

I live up the road in high point and I'm surprised a cop got out in the snow to mess with you. Generally cops don't waste their doing doing that kind of thing except in the summer when the weather is nice.

I'ts good it will be dismissed ,and I don't like heavy helmets ,but hate being in emergency/recovery rooms (if lucky) more.

it was right before it started snowing when i got pulled last saturday lol. gonna try to see if i can git it throwed out before jan. 21. **** i might not be here in salisbury that day i never know. i got better things to be do than sit inna court room lol oh we got some snow today. didnt ride in it

You might be able to get the clerk to toss it. Go down there and show the clerk the helmet. He might dismiss it.

I got the clerk to dismiss a no helmet ticket on my motorcycle.

yeah thats what he means and also you might call the da's office I doubt they want to go to court for such a mickey mouse thing.

well i talked to them today. they said i DO have to be in court Jan. 21. they said in some other counties in NC they could dismiss it early but not in Rowan county. i live in conrupted county imma sad to say lol

They want to play hard ball. Remember it's all about the money. When you go to court the clerk will ask you how you plead. Tell them, not guilty, and you want a jury trial, unless they're offering to dismiss.

At that point the shiite will hit the fan, and it becomes like a poker game. They want to fake you out by acting like there's nothing they can do. If there's a trial that means paying the judge, prosecutor, clerk, the cop, and a jury. They know they'll end up losing money no matter what the verdict is. Usually the judge at this point will offer a deal. Might be half price, or maybe just dismiss the whole thing. You have to decide if the deal is worth it. If you don't like the offer you can make a counter offer, like how about just dismiss the whole thing and you promise not to do it again.

If it's me and they're not dismissing it, I ask for the trial almost every time. In the trial your first best chance is the cop doesn't show up. At that point they'll dismiss the ticket, and the judge will be really pissed at the cop. If the cop shows up you'll probably lose the action. He'll be able to say the helmet you were wearing wasn't dot approved. They'll take his word over yours. I wouldn't show the jury a different helmet than the one you were wearing, but I would show the jury the helmet you were wearing so they'll know you were wearing one and get to see it.

Different states have different ways the jury can decide the trial. In Texas if the jury finds you guilty, it gets to set the fine. Usually the jury will access a fine that's a lot lower than what the judge would ask for, especially if they feel you're guilty, but the charge is a chicken chit money grab like in this case.

Remember this is just an equipment violation and all they can do is fine you.

In this case it's not worth hiring lawyer for a equipment violation. Lawyers only want to make a deal with the court. If the case actually goes to trial a lawyer would charge a ton of money to defend it.

The main advantage to having a lawyer is the court will usually offer a lawyer a better deal then they off you.

The last time I had to go to traffic court, seat belt violation, I pled guilty with an explanation. I told the judge that I had the best of intentions and I never had so much as a warning before. It was just a misunderstanding. What he did was give me a prayer for judgment . Nothing on my records and I paid the court cost. That is like a hundred bucks or so.

If worst comes to worse face it, you did know better than to ride a motor bike without the proper helmet. Don't get me wrong, I ride with with no helmet, but I expect one day to get stopped, but I haven't so far.

Sometimes you have to just fess up to it and pay the piper. I know it's a chicken salad law, but so is the seat belt law.

Just wear what the law says and deal..
I ride an electric bike that I had to spend an EXTRA $300 just to make it legally a bicycle..
I could have just not added two Cycle Analysts and stayed under 20, but the law requires that my bicycle can't be ABLE to achieve 20...
The $300 is well worth it, for being totally compliant with the law and be able to be smug about how legal I am and there's NOTHING a cop or judge can say about it.

I go along with that my ebike will do under twenty so its a bicycle not a moped. Thats going to be my defense. We won't mention that i run a bigger motor to get it up to twenty which is illegal.

No one is going to clock me at over twenty not even downhill with a tail wind on that thing. I'm going to hold onto it after I build the gasoline bike just in case they pass that moped registration law here.
