need help identifying a motor (moped or motorcycle?)

I'm relatively new with motorized bicycles, and I was wondering about a motor I was looking at getting for a bike, though I'm not quite sure if it's technically legal in my state (to be considered a moped that is). If not, any suggestions on a motor that would fit the definition of a moped would be great. I've posted a couple of links to the Kentucky law and to the motor I was thinking about getting. Any help would be appreciated. (the thing I'm concerned about is the brake hp, all that's listed is the hp and I'm not sure how that would figure in)
