As long as the motor is less than 50cc's it falls into the Moped category...
To legally ride on the public streets you DO need a drivers license, however you do NOT
need a MC endorsement. Also, the bike must have a headlight, brake light
AND YOU ARE REQUIRED TO GET A MOPED LICENSE PLATE.
I do not know the cost of the moped tag, but there are some innovative systems for putting lights and more specifically BRAKE lights...

The only municipality that I know of that allows a bike with a gas motor on it and you don't need a DL is Daytona and if you leave the city limits, you are then riding a moped and you need a DL
