NYS considers it a motor vehicle.
Since it has no VIN, it cannot be registered or insured.
According to NYSDMV If you ride in NY you are subject to arrest.
I ride every day anyway, and have passed many police who paid me no mind.
Of course, I obey traffic laws, stop at stop signs, give cars the right of way.
If you ride normal and regular, there will be no problems.
If you ride like an @$$hole, then expect problems.

May i ask u sir, what u wear when you ride your motorize bicycle?
Helment? bicycle helment or motorcycle?
What else should i wear so the police wnt bother 2 much?

Nothing special, just regular clothing, a shirt and jeans.
No helmet, but if they wanted to see one, it's in the garage.

I went to the NY DMV site, the only thing you may be able to do is be classified as a moped. This means lighting, horn, braking, speedometer/oedometer, mirrors and engine requirements. You would also need a drivers license and registration.
