40 MPH average or very occasionally?
Really, if you want to consistently go 40 mph, you should think about getting a 150cc, street legal scooter. Because with all things said and done, the amount of time and money spent, you'll have that much invested in the broken bits on the bike engine and bike itself.
If just only occasionally, on a long downhills, with a tailwind, you want to explore the upper reaches of the 30 mph range, I'd be seriously looking at a Golden Eagle with a Tanaka PureFire 47 cc.
