Wow very interesting. I've had no problems as of yet, but I'm in a tiny ag town. The first customer I have lives in New Mexico, so I just said good luck, don't drive like a jerk, ya probably won't get messed with. But anyway. Good knowing there's others out there. Good luck to all.
This is how it stands now as best I can tell.

Originally the legal authority's thought motor bicycles could be considered as mopeds, and therefore regulated as such. I think their thinking must have changed over time though because of possible problems trying to describe a motor bicycle and a moped as the same type of vehicle.

Texas law considers all motor vehicles to be self propelled vehicles. Mopeds are described as motor driven cycles. Motor driven cycle also implies self propelled. That's were the problem occurs. My motor bicycle can't drive away from a stop without peddle assist. If you have to peddle it to get going from a stop, that's not self propelled.

I think prosecutors have gotten the word that if there's a court challenge there's a good possibility they could lose if the defendant knows the right thing to say in trial. I believe that's the reason charges are usually dismissed if there's a challenge, because they don't want to take a chance on setting precedent.
The club is in it's infancy right now... Working on Corporate Charter that would work for our Association to Sanction and provide a Group Insurance Provision while still qualifing for a 501c3 tax deduction so Membership and Business's can have right offs. An association could then bring in other clubs and sponsor them thru a risk management umbrella. Then events that promote our Amatuer Sport Nationwide could pool resources and impact a positive environment.

    Club Stuff

Safety Classes & Intro to Legal Requirements (With Local PD, Speaker to elaborate)
Sanctioned Risk Management (Licensed Event, Ass. Bonding)
State, National Amatuer Sports, Future International Body Affiliations
Competitive Sport Developement and Implimentation of Basic Letter of Intent
Classes and Seminars Introducing & Promoting a Motorized Bicycling Certification Program
Meaning Youth & Adult Certifications to safely operate, build and instruct others amatuer Motorized Bicycling as a Sport or Recreation.
From what I've been able to tell, in Texas there's no definition of a gas powered motor bicycle. I've been riding in about 6 citys to date in the Dallas area since last October with no problems.
So, being from Texas, what constitutes a legal motor bicycle? I see they have a 31 cc restriction, which pretty well means I can use a weed eater motor.. Anyhow I'm interested in the group. Shoot me some info plz... :)
That's a nice bike btw. Happy riding.
